A court appointed special master hears limited matters in active civil litigation as directed by the judge, including: case management matters, discovery matters and identified factual disputes such as accounting issues.
Mr. Yarnell's twenty years experience as a trial lawyer in complex commercial matters, together with many years managing a busy civil trial calendar while on the bench, has lead to a keen understanding of the needs and difficulties presented in the cost effective resolution of complex disputes. He has a working knowledge in most commercial areas, including: construction, real estate, banking, sales, franchise, technology and intellectual property. Mr. Yarnell also has considerable experience in the areas of personal injury, wrongful death and professional negligence.
Mr. Yarnell was actively involved in the implementation of Arizona's mandatory civil discovery disclosure rules, is familiar with the nature and needs of civil discover, and is current on the law of work product and attorney-client privilege. He has attended and has presented various continuing legal education courses on electronic discovery issues.
Mr. Yarnell, while sitting as a trial judge on many hundreds of cases of all types during his thirteen years as a judge on the Maricopa County Superior Court trial bench in Phoenix, Arizona, appointed and supervised a number of civil case special masters.
Since retiring from the trial bench he has been appointed a number of times as a Discovery Special Master by the Maricopa County Superior Court.
